1. Agreement
This End User Licence Agreement ("EULA") is a binding legal agreement between you ("User" or "you") and Wallmate ("we", "us", or "our") governing your use of the Wallmate macOS application and any associated content, updates, or services ("the App").
By downloading, installing, activating, or using the App, you confirm that you have read, understood, and agree to be bound by this EULA in full. If you do not agree, do not install or use the App. This EULA should be read alongside our Terms & Conditions and Privacy Policy, which are incorporated by reference.
2. Grant of Licence
Subject to your compliance with this EULA and payment of any applicable fees, Wallmate grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to:
- Install and use the App on macOS devices associated with your licence
- Access and use wallpapers made available through the App for personal, non-commercial purposes
This licence does not constitute a sale of the App or any content within it. All rights not expressly granted here are reserved by Wallmate.
3. Licence Model and Activation
Your licence is tied to your purchase and is activated through your Polar license key together with a randomly generated anonymous identifier stored securely in your system Keychain. The identifier is used solely to validate and manage your licence across sessions and devices.
Your licence is subject to a device activation limit as specified at the time of purchase. You may not exceed this limit by activating the App on additional devices without obtaining an appropriate licence. Attempts to circumvent activation limits — including but not limited to manipulating the Keychain identifier, spoofing device signals, or key sharing — constitute a material breach of this EULA and will result in immediate licence termination.
4. Restrictions
You may not, and you may not permit or facilitate any third party to:
- Copy, reproduce, redistribute, sublicense, sell, resell, or otherwise transfer the App or your licence to any third party
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent expressly permitted by applicable law
- Modify, adapt, translate, or create derivative works based on the App
- Remove, alter, or obscure any proprietary notices, branding, or labels within the App
- Use the App for any commercial purpose, including offering it as part of a service or product
- Use the App in any way that violates applicable local, national, or international laws or regulations
- Share, publish, or distribute licence keys or activation credentials
5. Wallpaper Content and Intellectual Property
All wallpapers available within the Wallmate library are the property of their respective creators and rights holders. Wallmate provides access to this content under licence and does not claim ownership of any third-party content. Your right to use wallpapers accessed through the App is limited to personal, non-commercial use on your own devices and does not grant you any ownership, redistribution rights, or licence beyond that described in this EULA.
The Wallmate name, logo, user interface, application code, and all associated intellectual property are owned exclusively by Wallmate and are protected by applicable intellectual property laws. You may not copy, reproduce, or use any of these without our prior written permission.
6. User-Submitted Content
If you submit wallpaper content through the App for community sharing, you represent and warrant that:
- You are the original creator of the content or hold all necessary rights and permissions to submit and share it
- Your submission does not infringe the intellectual property, privacy, or any other rights of any third party
- You accept full and sole liability for any content you submit
By submitting content, you grant Wallmate a non-exclusive, royalty-free, worldwide licence to host, display, and distribute the submitted content to other users of the App for personal, non-commercial use. You retain ownership of your content. Wallmate does not claim any intellectual property rights over user-submitted content and may remove any submission at its sole discretion.
Wallmate is not responsible for user-submitted content and does not endorse or verify the accuracy, legality, or appropriateness of any submission.
7. Updates and Changes to the App
Wallmate may from time to time release updates, patches, or new versions of the App. Where such updates are made available, this EULA will apply to the updated version unless a new agreement is presented. We reserve the right to modify, discontinue, or deprecate features of the App at any time without liability to you.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, Wallmate expressly disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the App will be uninterrupted, error-free, secure, or free from harmful components
- Any warranty regarding the accuracy, reliability, or completeness of any content available through the App
You use the App entirely at your own risk. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Wallmate, its developers, affiliates, and licensors shall not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:
- Loss of data, profits, revenue, or business opportunities
- Damage to hardware, software, or other property
- Costs of substitute goods or services
Arising out of or in connection with your use of, or inability to use, the App — even if Wallmate has been advised of the possibility of such damages. In no event shall our total liability to you exceed the amount paid by you for the licence in the twelve months preceding the claim.
10. Termination
This EULA is effective from the date you first install or use the App and will remain in effect until terminated. Wallmate may terminate your licence immediately and without notice if you breach any provision of this EULA. Upon termination:
- All rights granted to you under this EULA will cease immediately
- You must cease all use of the App and delete all copies from your devices
- Any outstanding provisions that by their nature should survive termination — including intellectual property, disclaimers, and liability limitations — will continue to apply
You may also terminate this EULA at any time by uninstalling the App from all your devices. Termination does not entitle you to a refund unless otherwise provided under our Refund Policy.
11. Third-Party Components
The App may incorporate third-party libraries, frameworks, or services, including but not limited to the Sparkle auto-update framework, the Polar licensing service, and integrations that read content from third-party Mac apps such as macOS Aerial. These components are subject to their own licence terms, and your use of the App constitutes acceptance of those terms where applicable. Wallmate makes no representations or warranties regarding any third-party components.
12. Governing Law and Dispute Resolution
This EULA is governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of Seoul, Republic of Korea. If any provision of this EULA is found to be unenforceable, the remaining provisions will continue in full force and effect.
13. Entire Agreement
This EULA, together with our Terms & Conditions and Privacy Policy, constitutes the entire agreement between you and Wallmate regarding the App and supersedes all prior understandings, agreements, representations, or warranties, whether written or oral. No amendment to this EULA will be binding unless made in writing and published on this page with an updated revision date.
