1. Scope
These Upload Terms apply whenever you submit a video, image, or other media ("Submission") to the Wallmate community library through the Wallmate macOS app or any related tool. By submitting, you confirm that you have read and agree to these terms in addition to the Wallmate Terms & Conditions, Privacy Policy, and EULA.
2. Eligibility
Submissions are available only to holders of an active Wallmate Pro license. You must be at least the age of majority in your jurisdiction. We may suspend or revoke your ability to submit at any time, with or without notice.
3. Ownership and Rights You Grant
You retain ownership of your Submission. By submitting, you represent and warrant that you own all rights to the Submission, or that you have obtained all licenses, consents, and permissions necessary to grant the rights below.
You grant Wallmate a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, transcode, distribute, publicly display, and stream the Submission through the Wallmate app and related services. This license exists solely so we can make your Submission available to other Wallmate users. The license ends when your Submission is removed from the service, except where required to comply with legal obligations or to maintain backups.
4. Prohibited Content
You may not submit content that:
- Infringes any copyright, trademark, right of publicity, privacy right, or other intellectual property or proprietary right of any third party.
- Contains sexually explicit material, child sexual abuse material, or content that sexualizes minors.
- Depicts gratuitous violence, gore, self-harm, or animal cruelty.
- Promotes hatred, harassment, or discrimination against any individual or group.
- Contains personal information of any identifiable individual without their explicit consent.
- Promotes illegal activity, terrorism, or violent extremism.
- Contains malware, deceptive content, or content designed to mislead or defraud users.
- Includes commercial advertising, promotional codes, or solicitations not authorized by Wallmate.
You are solely responsible for the content of your Submission. Wallmate does not endorse or guarantee the accuracy, integrity, or quality of any Submission.
5. Review and Visibility
Submissions are reviewed by Wallmate before they appear publicly. We may approve, reject, edit metadata, or remove any Submission at our sole discretion, including after publication. Approval does not constitute endorsement and does not relieve you of responsibility for your Submission.
6. Reporting and Takedown
Anyone may report a Submission from within the Wallmate app. We take reports seriously and may remove Submissions while we investigate.
Copyright owners may request removal of an infringing Submission by emailing support@wallmate.app with: (a) identification of the copyrighted work, (b) the Wallmate URL or wallpaper ID of the allegedly infringing material, (c) your contact information, (d) a good-faith statement that the use is not authorized, and (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the rights holder.
Wallmate may terminate the upload privileges of users who repeatedly submit infringing content.
7. Indemnification
You agree to indemnify, defend, and hold harmless Wallmate, its operators, employees, contractors, and partners from and against any claim, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising from or related to your Submission or your breach of these Upload Terms.
8. No Warranty; Limitation of Liability
The community library is provided "as is" and "as available." Wallmate makes no warranties regarding any Submission or the availability of submitted content. To the maximum extent permitted by law, Wallmate is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your Submissions or other users’ use of them.
9. Removal of Your Own Submissions
You may request removal of your own Submission at any time by emailing support@wallmate.app from the email address associated with your Polar license, or by including your Wallmate device identifier and the wallpaper ID in your request. Removal may take a reasonable amount of time to propagate to existing app installations.
10. Changes to These Terms
We may update these Upload Terms from time to time. Material changes will be reflected in the "Last updated" date above. Continued use of the upload feature after a change constitutes acceptance of the revised Upload Terms.
11. Governing Law
These Upload Terms are governed by the laws of the Republic of Korea, without regard to its conflict of laws principles. Disputes are subject to the exclusive jurisdiction of the courts located in Seoul, Republic of Korea, except where mandatory consumer protection laws of your country of residence provide otherwise.
